However, the technology itself opens new ethical debates.
Accuracy and privacy remain the twin Achilles heels of AI-driven enforcement.

  • Privacy Risks: Identity verification using official documents is the most accurate method, but also the most intrusive. Experts warn of potential data misuse or leaks, particularly given Australia’s history of major data breaches in both government and private sectors.
  • Accuracy Limits: Facial recognition technology can misjudge users near the cutoff age. Tests showed 92% accuracy for adults, but performance declines sharply within two years of the 16-year threshold, risking false positives (under-16s slipping through) and false negatives (legitimate users being blocked).

Tech firms must now strike a delicate balance between user safety and digital rights, a dilemma with no perfect solution.

User Recourse and Data Handling

Meta has confirmed it will notify users identified as under 16, offering them two choices:
delete their content permanently, or allow the company to store it until they reach legal age.
TikTok and Snap have committed to similar measures.

Users who believe they were wrongly flagged will be directed to third-party age-estimation services for review, though Snap is still developing its mechanism for appeal.
The process underscores the growing interdependence between governments, private tech, and AI auditing firms in enforcing digital policy.

The implications of this law extend far beyond Australia’s borders. Governments in Europe, the UK, and North America are watching closely, weighing whether similar legislation could be feasible or enforceable within their own jurisdictions.

For the tech giants, Australia’s decision may become a blueprint for future regulation, forcing them to develop scalable, privacy-respecting verification systems that can be applied globally.
